THE DATA CONTROLLER

I Am A Fan is the business responsible for the collection and processing of any personal information about you and is responsible for ensuring that such processing complies with applicable data protection laws, including the California Consumer Privacy Act (the "CCPA") and the California Privacy Rights Act (“CPRA”). THE INFORMATION WE GATHER

The type of information we gather online falls into the following categories:

Aggregate Website Usage Information:

We collect and store information about the pages viewed by all of our Website visitors. We may then use this data in aggregate form to identify overall Website visitor behavior patterns. Our goal in using this information is to improve our Website by making it more responsive to the needs and preferences of our users. Our Web servers automatically collect information about each visitor who requests the Website pages, including your computer's internet protocol (IP) address. This IP address allows us to identify your computer on the internet so that the Web content you request from us can be sent to you. Other information collected automatically may include, but is not limited to, the operating system you use to access the Website; the type of Internet browsers you use; information about the way you use the Website; information associated with your Internet service provider; the content you view and/or download, search terms you enter, features you use, and the date and time of your visits to the Website. From time to time, we may provide portions of this aggregate Website behavior information to vendors, consultants, potential advertisers, and/or news agencies. We would typically do this in order to demonstrate the amount of interest in our Website and/or to plan for technical infrastructure improvements.

Voluntary Registered User Information:

If you visit our Website and wish to provide a hand-raise (email-verified expression of watch interest), provide Submitted Material as described in the Terms, or receive future newsletters to learn about our later development and promotions or to purchase our products, you will need to sign up for our newsletter or you may elect to register an online account. The information you provided during these processes is first and last name, email address (used as the username in login), phone number, and password, which may or may not include the day and month of your birth. All such information is collectively referred to herein as “Personal Information.” Personal Information means information that identifies, relates to, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person or household and includes the type of information listed in this Section, including one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person, or as further defined in the CCPA and CPRA We may also use third parties such as Stripe to process your payment. You may use this username and password to login to your online account to check your order history, order status, order’s tracking number, etc.

Data that has been de-identified or aggregated so that it cannot reasonably be linked to an individual consumer is not Personal Information, and we may use that data for any purpose. Personal Information also does not include publicly available information, such as information that is lawfully made available through federal, state, or local government records.

We do not share Sensitive Personal Information, as defined by California law, for purposes other than those specified in Section 7027(m) of the California Consumer Privacy Act. We also do not share Sensitive Personal Information for cross-context behavioral advertising. We do not sell Sensitive Personal Information. Sensitive Personal Information includes, but is not limited to, social security numbers, driver's license numbers, state identification card numbers, passport numbers, financial account information in combination with security codes, precise geolocation data, racial or ethnic origin, religious or philosophical beliefs, union membership, genetic data, biometric data for identification purposes, health data, and data concerning sex life or sexual orientation. We only use Sensitive Personal Information for processing payments and fulfilling orders requested by purchasers and for purposes that do not infer characteristics about consumers.

Your Sensitive Personal Information will not be used for any additional purposes that are incompatible with the disclosed purposes listed above, unless we provide you with notice and obtain your explicit consent as required by law; this consent will be required before said use in some jurisdictions. You have the right to limit the use and disclosure of your Sensitive Personal Information to those uses necessary to perform our services. You have the right to limit the use of your Sensitive Personal Information or have your Sensitive Personal Information limited by default, which you can exercise by clicking on “Your Privacy Choices (opt out)” on our home page.

In order to register on or purchase products from the Website, your browser must be set to accept certain essential cookies that are necessary for the Website to function. However, you may decline optional cookies used for analytics, advertising, or other non-essential purposes. A cookie is a small piece of data housed in a text file or folder on your computer's hard drive that helps us recognize you when you visit our Website. We use cookies to help us remember things such as the following: (1) the profile facts you tell us about yourself, (2) your specified areas of interest on our Website, (3) the items you've placed in your shopping basket, and/or (4) the Website pages you visit as you shop. The only Personal Information our Website cookie can contain is information that you supply yourself. Our cookies cannot read data from other parts of your computer. If you would like more technical information about how cookies work, take a look at http://www.cookiecentral.com. As stated above, you must enable cookies on your Web browser for the Website to function correctly. If you are concerned about information contained in your Website cookie, you may delete the file(s) at the end of each browser session. View your browser's help file for more information on cookies (Click “Help” in the toolbar of most browsers for instructions). Click-stream data is information that describes the page-by-page paths you take as you browse through our Website. Using cookies, we track and store this information to help us positively customize your shopping experience. We may use click-stream data in the aggregate to provide improved services to groups of shoppers who behave similarly. We may also use it on an individual basis to improve your specific shopping experience.

Like most websites, we may track use of the Website so we can analyze usage patterns and improve our Website. The technologies we use to monitor the Website’s activity may include cookies and clear GIFs, among others. Through the use of a cookie, in addition to the uses indicated above, we may automatically collect information about your activity on the Website, such as the links you click, the searches you conduct, and the date and time of your use of the Website. When you sign in to your account we may record your user ID and the name on your account in the cookie file on your computer, as applicable. For security purposes, we will encrypt any usernames and other user member account-related data that we store in such cookies. We may also allow third-party providers to serve cookies from the Website to allow them to assist us in various activities, such as analysis and research on the effectiveness of the Website, content, and potential advertising. Cookies may be persistent or stored only during an individual session.

Clear GIFs (a.k.a. web bugs, beacons, or tags) are small graphic images placed on a web page, web-based document, or in an email message. Clear GIFs are invisible to the user because they are typically very small (only 1-by-1 pixel) and the same color as the background of the web page, document, or email message. We do not use clear GIFs to collect Personal Information about you; however, we may use clear GIFs to capture statistical usage information for our Website or the services and products offered through the Website. We may correlate this information to a user to personalize the user experience and for statistical analysis of user experiences on our Website.

We may also embed social media widgets, such as Facebook, Pinterest, TikTok, YouTube, and Instagram and others as indicated below to allow you to see things like the number of likes/shares/recommends and “like/share/recommend” our webpages, as applicable for each potential social media widget, and to share product images. These widgets may collect your IP address, your web browser user information, store and retrieve cookies on your browser, embed additional tracking, and monitor your interaction with the widget, including correlating your applicable social media account with whatever action you take within the applicable widget (such as e.g. “liking/sharing/recommending” our webpage), if you are logged in to such applicable social media. For more information about how this data may be used, see, as applicable, Facebook’s data privacy policy, Pinterest’s data privacy policy, Instagram’s data privacy policy, TikTok’s data privacy policy, and YouTube’s data privacy policy. When you interact with these social media widgets, you are also subject to those platforms' privacy policies and terms of service.

We also maintain log files that contain IP addresses. In general, we may use log files to monitor traffic on our Website, to troubleshoot technical problems, and to potentially report aggregate information to our advertisers. In the event of user abuse of our Website, however, we may block certain IP addresses or console IDs, as applicable. If available, IP addresses and console IDs may be used to personally identify you in order to enforce our Terms.

By using the Website, you acknowledge the use of essential cookies as described below. For non-essential cookies (such as performance, analytics, functionality, and targeting cookies), you may manage your preferences through our Cookie Consent banner:

  • Strictly Necessary or Essential Cookies: these cookies are essential in order to enable you to move around the Website and use its features.
  • Performance and Analytics Cookies: Google Analytics ("Analytics") is Google's free web analytics tool that helps us understand how our visitors engage with the Website. Analytics collects information anonymously and reports website trends without identifying individual visitors. Analytics uses its own set of cookies to track user interactions with the Website. These cookies are used to store information, such as what time the current visit occurred, whether the visitor has been to the Website before, and what site referred the visitor to the Website. Analytics customers can view a variety of reports about how visitors interact with their website so they can improve their website and how people find it. A different set of cookies is used for each website, and visitors are not tracked across multiple sites. Analytics customers are obliged to notify users of their use of analytics software. To disable this type of cookie, some browsers will indicate when a cookie is being sent and allow you to decline cookies on a case-by-case basis. In addition to declining cookies, you can also install the Google Analytics Opt-out Add-on in your browser, which prevents Google Analytics from collecting information about your website visits. You can also opt out by clicking here.
  • Functionality Cookies: these are small data files that remember the choices you make on the Website. These cookies help to make your visit more personal and are deleted automatically when you close your browser or the session expires.
  • Targeting Cookies: these cookies and similar technologies are used to collect information about your online activity in order to display advertising that may be more relevant to your interests, limit the frequency of ads, and measure ad effectiveness. These technologies may be used by us or third-party advertising partners. If their use involves cross-context behavioral advertising, California residents may have the right to opt out of the sharing of their personal information, as provided in this Privacy Policy.

You can block or disable cookies on your device at any time by indicating this in the preferences or options menus in your web browser. You can also delete the cookies that are stored on your device. However, blocking, disabling, or deleting cookies may limit your ability to view all the pages of the Website and/or otherwise hinder your use of the Website. You can find more information about cookies at www.allaboutcookies.org. To learn more about, or to opt-out of Google's analytic and marketing services, visit Google Analytics Terms of Service, the Google Privacy Policy, and Google Analytics Opt-out Add-on.

You may also block or disable cookies by selecting the corresponding options in our Cookie Consent banner presented to you upon your first visit to the Website.

From the Effective Date moving forward, we will collect and use these categories for the business purpose(s) indicated herein.

Right to Opt-Out:

You have the right to opt-out of the sale or sharing of your personal information to third parties. You also have the right to opt-out of the use of your Sensitive Personal Information for purposes other than those permitted under the CPRA. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) business days from the date of the request submission. We will wait at least twelve (12) months before asking you to opt back in to the sale or sharing of your personal information. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions located at the bottom of the email. Please note that you cannot opt-out of non-promotional emails, such as those relating to your account, transactions, servicing, or our ongoing business relationship. You may continue to receive service-related and other non-marketing emails. If you receive marketing text messages from us, you may opt out of receiving further marketing text messages from us by replying STOP to our marketing message.

Right to Know:

You have the right to receive information from us regarding the specific personal information we have collected, categories of personal information we have collected, the sources from which we have collected personal information, the purposes for which we have collected and shared personal information, the categories of any personal information we sold as well as the categories of third parties to whom such personal information was sold, if any, and the categories of personal information that we disclosed for a business purpose in the twelve (12) months preceding your "right to know" request. In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to Data Portability:

You have the right to receive a copy of your electronic personal information in a portable and, to the extent technically feasible, readily useable format that allows you to transmit this information to another entity without hindrance, delivered within forty-five (45) days of your request.

Right to Non-Discrimination:

You have the right to not receive discriminatory treatment if and when you exercise your rights under the CCPA.

However, we may offer you certain financial incentives permitted by the CCPA and CPRA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

Cookies:

Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. For more details, see the Click-Stream Data, Cookie Technology, Clear GIFs, and Usage Data Section herein for more information. You may also deny the acceptance of cookies by selecting the corresponding options in our Cookie Consent banner.

Do Not Track:

Some Internet browsers may be configured to send “Do Not Track” (“DNT”) signals to the online services that you visit. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals, nor do we alter our Website’s data collection and use practices when we see a DNT signal from your browser. However, we do honor other opt-out preference signals as described in the Global Privacy Control section below. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Global Privacy Control:

New standards are being developed for a universal Opt-Out Mechanism, such as the Global Privacy Control (“GPC”), which allows users with GPC-enabled browsers and devices to send a signal that will communicate the user’s request to opt-out of sales of their personal information and to opt-out of certain sharing of their personal information. The CPRA and other laws require the acceptance of Opt-Out Preference Signals such as the GPC, as a valid method for individuals to transmit an Opt-Out request for the selling or sharing of personal information. If we detect such a signal from your device or browser, we will honor it within fifteen (15) business days of receipt.

Choosing Not to Share Your Personal Information:

If you do not provide information and/or Personal Information that we need to provide the Website, we may not be able to provide you with the Website or certain features. However, we will not discriminate against you for exercising your rights under the CCPA/CPRA, including by denying goods or services, charging different prices or rates, or providing a different level or quality of goods or services, unless such difference is reasonably related to the value provided by your personal information or is otherwise permitted by law. We will tell you what information you must provide to receive the Website when we request it.

Third-Party Platforms or Social Media Networks:

If such functionality is available and you choose to create an account through or connect the Website with another third-party platform, you may have the ability to limit the information that we may obtain from the third-party at the time you log in to the Website using the third-party’s authentication service or otherwise connect your account. You may also be able to control your settings through the third-party’s platform or service after you have connected your accounts.

Payment Information and STRIPE

You agree to honor your payment obligations and acknowledge and agree that our third-party processor will store your payment information. Stripe provides us with the online payment platform that allows us to collect payment for our Services, where payment is applicable. Your information and Personal Information are processed by Stripe. They store your data on a secure server behind a firewall. Stripe’s Privacy Policy is here, and applies to all data they collect. It is encrypted according to the requirements of the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted, unless the payment information is selected by you to be saved for your future transactions; if saved, such payment information may be selected by you for deletion. As a service provider processing personal information on our behalf, Stripe is contractually obligated to maintain appropriate security measures and use your personal information only as directed by us and consistent with this Privacy Policy.

Text marketing messages will not exceed three (3) per day. You acknowledge that consent to receive text messages is not a condition for any purchase. If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you with in any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, may not be processed as effectively as the standard STOP command, though we will make reasonable efforts to honor clear opt-out requests. Message and data rates may apply. For any questions please text HELP to the number you received the messages from. You can also contact us for more information. If you wish to opt out please follow the procedures above.
